Submit A Vehicle

(1) Vehicle Owner grants Hagerty the right to: Publish his/her name, automobile club affiliations, details regarding the Vehicle’s history and any other reasonable facts relating to the Vehicle Owner and/or the Vehicle(s) which is supplied by the Vehicle Owner to Hagerty (the “Information”). Produce photo(s) or video(s) that contain the likeness, image or appearance of the Vehicle(s) (the “Media”). (2) Vehicle Owner agrees that Hagerty may use and distribute the Information and/or the Media throughout the world in any physical, electronic or other medium including, but not limited to, editorial content, advertising, promotional or educational materials. (3) Vehicle Owner shall have no right of approval, attribution or claim to compensation in connection with Hagerty’s use of the Information and/or the Media.

Vehicle Owner represents and warrants that he/she holds the legal title in the Vehicle(s), the Vehicle(s) is/are registered, and the Vehicle(s) is/are insured by Vehicle Owner for all liability and physical damage, covering the full value of the Vehicle(s), while under the Vehicle Owner’s care, custody and control.

In consideration of the acceptance of this application by Hagerty Events, LLC (“Hagerty”), the undersigned agrees to release, discharge, and hold harmless (1) Hagerty and all related and affiliated entities, and their respective officers, directors, owners, agents, and employees; and (2) all other contestants and officials (collectively, “Released Parties”) from any and all liability that may arise, directly or indirectly, now or in the future, by reason of any injury, death, damage (including consequential, incidental and punitive damages), loss, costs, expenses, or attorneys’ fees in connection with their participation in the event, unless caused by the gross negligence or willful misconduct of Released Parties. In the event of gross negligence or willful misconduct by any of the Released Parties, this release will remain valid and effective with respect to the Released Parties not responsible for or involved in the gross negligence or willful misconduct. . The undersigned (1) warrants that they have personally read the rules and regulations; (2) permits Hagerty to use the enclosed photographs and photos taken the day of the event and information of the entrant’s automobile(s) and/or motorcycle(s) for publication and program inclusion; and (3) agrees to follow all COVID prevention protocol, which may include wearing masks, keeping 6 feet of distance, and sanitizing upon arrival. This release extends to and includes any and all claims of liability, arising from or in any way related to the undersigned’s participation in the event, whether known or unknown at the time of signature. To the extent any applicable law prohibits waiver of unknown claims, the undersigned acknowledges the possibility of unknown claims and specifically waives the application of that law to any claims in any way related to the undersigned participation in this event. The undersigned agrees, by their signature, that they have read the foregoing and accepts the terms and conditions

(1) Hagerty will not be liable to Vehicle Owner for: any negligence or misconduct of the Vehicle Owner or their representatives, or; special or consequential damages, including but not limited to, lost profits, loss of use, and costs of replacement, caused by Hagerty’s breach of contract, or any other cause whatsoever. (2) Hagerty’s liability pursuant to this Agreement, or under any theory of law, shall not exceed the total sum payable on behalf of Hagerty by its insurers in settlement or satisfaction of Vehicle Owner's claims. (3) This Agreement will be construed under and in accordance with the laws of the state of Michigan. (4) Any changes to this Agreement must be mutually agreed to by the parties in writing.

This Vehicle Usage Agreement (“Agreement”) is between Hagerty Media Properties, LLC, a Michigan limited liability company, with offices at 121 Drivers Edge, Traverse City, MI 49684, (“Hagerty”) and the titled vehicle owner (“Vehicle Owner”) named below. This Agreement will be effective on the date provided in the signature block below (the “Effective Date”).
